Temporary injunction granted for Constant Spring Market vendors

A temporary injunction has been granted by the Supreme Court preventing the Kingston and St Andrew Municipal Corporation (KSAMC) from forcibly removing vendors at the Constant Spring Market.
The injunction was filed yesterday by attorney-at-law Bert Samuels, who previously filed an injunction on behalf of vendors in June of last year.
The market is to be demolished to facilitate the widening of the Constant Spring Road as part of the Government’s major infrastructural development programme.
In court documents obtained by The Gleaner, the applicant, Nichol Sudiene, said that the action being taken by the KSAMC to evict him from the premises is in breach of his constitutional rights as a licensee in the property.
He contends that an injunction is the only means of redress for the breaches of his constitutional rights.
Last June, the Supreme Court granted the vendors a 14-day injunction, but this was not extended.
The vendors were last given an eviction notice for September 30, 2018.
