Immigration Corner | Exceptions to the field of study requirement for PGWP in Canada

Last week, I mentioned the field of study requirement that now applies to Post Graduate Work Permit (PGWP) applicants. After November 1, 2024, PGWP applicants will only be eligible for a PGWP if they obtained a university bachelor’s degree, master’s degree, or doctoral degree programme, regardless of their field of study, or if they graduated from another programme that falls in an eligible field. This is known as the field of study requirement. That means that your study should fall under the category of agriculture and agri-food; healthcare; science, technology, engineering and mathematics; trade; or transport.

There are, however, some exceptions to that general rule, so if you did not see your occupation listed in last week’s article, or on the government’s website, there is a chance that your study may fall in the categories for exemption as outlined below.

PROGRAMMES WITH HIGH EMPLOYMENT RATES:

There are some programmes that have consistently led to successful employment outcomes. Therefore, graduates of these special programmes that have historically had high employment rates may still be eligible for a PGWP even if they are not in the specified fields.

PROVINCIAL NOMINEE PROGRAMMES:

Some provinces may have their own criteria and exceptions under their Provincial Nominee Programmes. This means that a province may nominate graduates for permanent residency based on their specific labour market needs even if their field of study differs from the federal requirements.

SPECIALISED PROGRAMMES:

Certain specialised programmes that do not fall under the named categories but are deemed critical for specific sectors may also be considered for exceptions. This may include certain studies in arts, humanities, or social sciences that address unique labour market needs.

PILOT PROGRAMMES:

From time to time, the government introduces pilot programmes based on demand and labour market trends. This may create an opportunity for graduates who are able to satisfy the requirements under these pilot programmes to get a PGWP even if their field of study is not listed among the primary categories mentioned.

REASON FOR EXCEPTION

The government recognises that while they have current labour market analysis which warrants an immediate change, they deem it necessary to have exceptions,so that they have the flexibility to adapt to the evolving needs of the Canadian labour market.

The key is to check the government’s website and the designated learning institutions to ensure that your programme of study will be one that can meet the labour market needs. I also recommend that you read other articles about changes to the study permit application process before applying.
