A man who was in 2007 arrested and charged for murdering another during a scuffle over the wearing of a green armband, has been freed in the Home Circuit Court in Kingston.

Khalid Ohara, formerly of a Bull Bay, St Andrew address, was accused of stabbing Fabian McFarlane to death, during an altercation that also involved other men.

It was reported that on August 1, 2007, Ohara was approached by a group of men in Bull Bay, St Andrew who demanded that he remove the green armband he was wearing.

Ohara reportedly refused and McFarlane approached him and forcefully attempted to remove it.

During a scuffle, McFarlane was stabbed.

He was subsequently admitted to hospital.

Following his release from hospital, McFarlane was in and out of an infirmary before he eventually died on November 5, 2007.

Attorneys Tom Tavares Finson QC, and Donahue Martin Jr, who represented Ohara put forward a no-case submission, saying there was nothing to prove that the wound allegedly inflicted by Ohara caused McFarlane's death. 

Justice Bertram Morrison accepted the no-case submission and freed Ohara.
