RM to rule June 5 on Al Miller no-case submission in Dudus case

The Reverend Merrick 'Al' Miller will know on June 5 whether the corruption charge against him will be dismissed.

At that time, Resident Magistrate Simone Wolfe-Reece will make her ruling on a no-case submission made today by Miller's attorney, Jacqueline Samuels-Brown.

The popular pastor of the Fellowship Tabernacle is on trial for attempting to pervert the course of justice after drug kingpin Christopher 'Dudus' Coke was captured in a motor vehicle he was driving along the Mandela Highway, St Catherine in June 2010.

Seeking to convince the magistrate to allow the case to go forward, prosecutor Larone Montaque-Williams said Miller's conduct on the day Coke was captured was all part of a series of actions which shows that he knew what he was doing.

According to Montaque-Williams, that conduct began when the clergyman picked up Coke in St Ann and continued until he was forced by the police to stop the vehicle transporting Coke.

She says it is clear inference that Miller's intention was to evade the police.

Miller has said he was taking Coke to the United States Embassy in Kingston to be surrendered to authorities there.

Today, Samuels Brown, in her submission, said she found it curious that police investigators did not raise this with Miller when they interviewed him.

"Not exploring this matter with the defendant ... the prosecution must accept that in his state of mind he was not doing something underhanded," Samuels-Brown argued.

"And as you know, your honour, before the charge can be established you have to show the defendant's state of mind," she continued.
