Jamaica College school uniform dispute now before Court of Appeal

The legal battle between acting principal of Jamaica College, Wayne Robinson, and former Jamaica College Old Boys' Association President, Major Basil Jarrett, over the sale of school uniforms is to be determined by the Court of Appeal.

Tomorrow, there will be a case management conference before Justice Georgiana Fraser in chambers at the Court of Appeal.

Robinson has filed an appeal against a Supreme Court ruling in March, which threw out the lawsuit he had brought against Jarrett.

He had filed a lawsuit in his personal capacity accusing Jarrett of financial misconduct following the sale of school uniforms by the Old Boys Association.

Jarrett countered the lawsuit, describing it as a vindictive move aimed at punishing him for his opposition to the school board's decision to retain former principal Ruel Reid.

In his defence to the lawsuit, Jarrett had contended that the claim was an abuse of the court process and was frivolous and vexatious.

Jarrett highlighted the fact that an independent audit of the association showed that there were no missing funds.

Jarrett had also produced receipts and invoices to refute Robinson's allegations. 

It was also argued that even if there had been a valid case, the actions in question were undertaken by the JCOBA and not by him personally.

Justice Opal Smith dismissed the lawsuit on March 8 and granted Robinson leave to appeal her decision.
