A man who was arrested on gun charges after he was accused of firing at the police was freed on Tuesday.

Shaquille Davis, otherwise called 'Tika' and 'Oshane Gordon', was found not guilty of illegal possession of firearm and ammunition and three counts of shooting with intent after Justice Vaughn Smith upheld a no-case submission in the Gun Court.

The prosecution alleged that on February 12, 2022, about 11 p.m., police officers were on patrol in the vicinity of North Street in downtown Kingston when Davis fired at them.

The police reportedly retaliated and fired at Davis who escaped through a yard and jumped through a fence.

Following investigation Davis was later arrested and charged.

However, his lawyers, King's Counsel Tom Tavares Finson and Marcus Moore, argued during the no-case submission that there were serious issues with identification and the credibility of the police witnesses.

While highlighting that the lighting on the night in question was insufficient to make a proper identification, the lawyers submitted that the two witnesses had different accounts as it relates to the man's identification.

One witness testified that he saw the accused when he fired, and was able to see his face for about five seconds while chasing and shooting at him, while the other witness said he knew Davis but was unable to point him out at the identification parade.
