DPP defends decision not to prosecute Symbiote for alleged telecoms breach

The Director of Public Prosecutions (DPP) Paula Llewellyn has sought to defend her decision not to prosecute Symbiote Investment Limited for alleged breaches of the Telecommunications Act.

In a statement, the DPP charged that "partial facts" from unnamed sources in a newspaper article created an unfortunate impression designed to undermine the rationale of her ruling.

Llewellyn said her office issued a ruling that criminal charges ought not be laid as the prosecution would not be able to satisfy the very high standard of proof beyond a reasonable doubt.

In a media release on Thursday, the DPP said the ruling was prepared and researched by Deputy Director of Public Prosecutions Andrea Martin-Swaby, who heads the Cybercrimes Unit in her office.

"I discussed it with her and approved the content and decision in this ruling," Llewellyn said.
