'Butch' Stewart's common-law widow seeking injunction against lawyer and Adam Stewart
American businesswoman Cheryl Hammersmith-Stewart, the common-law widow of late hotelier Gordon 'Butch' Stewart, is seeking court orders for attorney-at-law Rachel Yvonne McLarty and executive chairman of Sandals Resorts International, Adam Stewart, to hand over certain documents to her.
In the claim filed in the Supreme Court last month, the claimant is applying for an injunction for the defendants to deliver up to her all hard copies of her "confidential/privileged" materials in their possession or control.
She is also seeking an injunction requiring the defendants “to destroy by permanently deleting all electronic copies of the claimant's Confidential/Privileged Materials and all electronic files containing any information from her Confidential/Privileged Materials in their possession, custody or control, including in the case of the Second Defendant (Adam Stewart), in the possession of the second Defendant's Attorneys.”
An order is also being sought to restrain the defendants from "any further misuse of the claimant's confidential/ privileged materials."
The claimant is seeking damages which include damages for conspiracy against the defendants. She has outlined in court documents, alleged communication between the defendants. She further contends that the defendants' alleged breaches of confidence have caused loss and damage to her.
King's Counsel Caroline Hay is representing the claimant in the suit which was filed on October 31.
Hotel mogul Stewart died on January 4, 2021 and since then there have been serious legal challenges in the Bahamian Court between his American family which comprises Hammersmith-Stewart and their three children, and the Jamaican families over his will and two Bahamian trusts.
The Jamaican family members are Adam, his sister Jaime Stewart-McConnell and brothers Brian Jardim and Robert (Bobby) Stewart.
Bobby supports some of Cheryl's claims in the legal battle over the will and trusts.
