Men accused of beating Mario Deane's alleged attacker to be freed

The two men charged for beating an accused in the Mario Deane murder case are set to walk free.

The complainant, Marvin Orr, told the court today that is he no longer interested in pursuing the matter.

The accused, Colin Malcolm and Omar Mitchell, are charged with assault occasioning bodily harm.

But as a result of Orr’s decision, the presiding magistrate, Natalie Hart-Hines, ordered that no evidence should be offered against Mitchell.

The magistrate also ordered a warrant for Malcolm, who was absent from the proceedings, to appear in court so that a no-evidence motion can be made for him as well.

It was alleged that on August 14, 2014, Orr was asleep in his cell at the Barnett Street Police Station when he was awakened by voices.

It is further alleged that one of the two men accused him of urinating in the passage and ordered him to clean it.

Mitchell then reportedly bashed Orr's head against a wall, and both men reportedly stepped in his stomach.

They were subsequently charged for assault-related offences.

The alleged attack on Orr happened just over a week after Deane, who was initially taken into police custody for possession of a ganja spliff, was beaten in his cell at the Barnett Street Police Station.

Deane subsequently died in hospital on Independence Day.

Orr and two other inmates, Adrian Morgan and Damion Cargill, were later charged in connection with Deane's death.

Their case will be mentioned on September 18.
